On 9 March 2025 we wrote:

Dear FOI Officer,

Freedom Of Information request

Proof of UK government's authority to operate in Shetland

In the absence of proof that the Crown owns Shetland and In the absence of proof that Shetland is part of Scotland, please provide information showing proof of the UK government's authority to operate in Shetland. The fact that you are unable to produce information showing how Shetland is part of Scotland casts doubt upon the legitimacy of the UK government's activity in Shetland. We presume that, as the UK government's legal department, you are the highest authority we can go to for information on the legal status of the UK government in Shetland. If not, please advise.

You say:

"GLD's purpose is to provide legal and litigation advise to its clients, the government departments. We do this by providing legal advice on the development, design and implementation of government policies and decisions, drafting secondary legislation and working with Parliamentary Counsel on primary legislation ...."

It will be obvious to you that only if Shetland is part of Scotland, can Scottish or UK legislation apply in Shetland. Any reliance on such legislation in the absence of proof that Shetland is part of Scotland is a circular argument. We are looking for a treaty, or a document of that stature. Bland assurances or presumptions will not do.

In the absence of the information requested in our first paragraph, do you have information to show that the UK government's activity in Shetland is not fraudulent?

If you do not hold this information, please expect further requests regarding proof of the legitimacy of the UK government's business in Shetland and the validity of any of your past operations in Shetland. Our requests are sequential, dependent on each other and are not to be regarded as asking for the same or similar information in terms of the 2002 Act, nor are they asking for a legal opinion.
