Dear FOI Officer,
Freedom Of Information request:
Proof that Shetland is part of Scotland
Please provide specific information showing proof that Shetland is part of Scotland. This
information is critical to your operations in Shetland and is something that should be at your
fingertips.
It will be obvious to you that only if Shetland is part of Scotland, can Scottish or UK legislation
apply. We are looking for a treaty, or a document of that stature. Bland assurances or
presumptions will not do.
If you have any doubt about the validity of this request, please refer to www.ourfois.com/name
If you do not hold this information, please expect further requests regarding proof of your authority,
your business in Shetland and the validity of any of your past operations in Shetland. Our requests
are sequential, dependent on each other and are not to be regarded as asking for the same or
similar information in terms of the 2002 Act, nor are they asking for an opinion.
Please refer to www.ourfois.com for further information.
It is possible that, during the transfer of information from the WhatDoTheyKnow.com to our own
dedicated site, there may have been some duplication. We apologise if this has happened and ask
you to disregard any duplicates. They are not intentional.

The Sovereign Nation of Shetland

Response to your request
"That Shetland is part of Scotland is recognised by the courts and shown by the ability of the Scottish and UK parliaments to legislate for Shetland, see for example the Local Government etc. (Scotland) Act 1994
There is publicly available information where the fact that Shetland is part of Scotland was recognised by the courts – see Lord Pentland's opinion in The Royal Bank of Scotland plc v Stuart Hill [2012] CSOH 110: [ARCHIVED CONTENT] THE ROYAL BANK OF SCOTLAND PLC v. STUART HILL"
--------------------------------------
In other words, having admitted in the previous request that they hold no information showing how the Crown owns Shetland (which would give it sovereignty and make Shetland part of Scotland) they rely on:
- the circular argument that Shetland is part of Scotland because the Scottish Parliament has passed legislation which is supposed to apply here, without explaining how, and
- The presumption that Scottish courts have authority in Shetland because they say so, and
- Stuart Hill's case with RBS, where Lord Pentland gave his opinion, without any submission by the pursuers (which was an abuse of process) and without considering the definition of sovereignty in The Laws of Scotland (which was not available to Stuart Hill at that time) and considering only facts that have since been debunked in Stuart's book (Stolen Isles).

This request is closed because the Scottish government has made its position clear. The next request asks how they have authority in Shetland based on the above.
