On 5 February we wrote:

Dear Electoral Commission,

In the absence of information showing how you have any business in Shetland, please provide information showing how any elections carried out in Shetland to date are valid.

Please note that this is not a request for the same information as previously requested, but a natural progression from those previous requests.

On 14 February 2925 they replied:

Dear The Sovereign Nation of Shetland,

Thank you for your email.

We do not hold the information you have requested.

Under the Freedom of Information act, where we have previously complied with a request for information made by any person, we are not obliged to comply with a subsequent identical or substantially similar request by that person. We believe your request falls into this category and the information you're seeking is substantially similar to previous requests. Therefor we are not registering this request as a new FOI.

The Electoral Commission is the independent body which oversees elections and regulates political finance in the UK. We work to promote public confidence in the democratic process and ensure its integrity. The Commission was established by Political Parties, Elections and Referendums Act 2000, giving it statutory responsibilities with regards to, but not limited to, parliamentary general elections, Scottish Parliamentary general elections and local elections.

ICO guidance stipulates that to comply with a freedom of information request "You do not have to create new information or find the answer to a question from staff who may happen to know it.". The Electoral Commission is not required to hold documentation relating to the sovereignty of individual constituencies that form part of the UK, or required to create them in order to perform its statutory function overseeing UK elections.

Section 16 of the Freedom of Information Act provides a duty to assist individuals who wish to make a request.
