FOI: Does the Crown own Shetland?

Home
FOI List

.

We want to find out how the Office of the Advocate General derives its authority in Shetland. We presume that authority will come from Shetland being part of the UK. As far as we are aware, in Scots law, sovereignty is the same as ownership of the land and the Crown's sovereignty is what will make Shetland part of Scotland. We therefore need infomation showing that the Crown owns Shetland.

Our initial enquiry, via WhatDoTheyKnow.com, on 9 January 2025 was:

Dear Office of the Advocate General for Scotland,

We made a request to the UK Government Legal Department, to which their response was:

Pursuant to Section 1(1)(a) of the Act, GLD informs you that it does not hold the information you have requested.

Subject to the Section 16 of the Act, GLD has an obligation to provide advice and assistance to applicants. GLD advises you to Office of the Advocate General for Scotland, who may hold the information.

In essence, our request is for information showing proof that the Crown holds allodial ownership of Shetland.

Yours faithfully,

The Sovereign Nation of Shetland

They replied on 12 January:
